By using the www.andalin.com and/or any of its sub-domains, you as a User expressly and explicitly agree to the entire contents of this Privacy Policy.

This Privacy Policy applies whenever you as a User uses or accesses www.andalin.com and/or any of its sub-domains.

1. Definition

   1. In this Privacy Policy, unless the context requires otherwise, the following words and expressions shall have the following meanings:

      "Andalin.com" means www.andalin.com or andalin.com website, including any of its sub-domains;

      
      

      "User's Data and Information" means any data and information related to the User including but not limited to:

      
      

      • the User's name, address, phone number, and fax number;

      • the User's legality documents (including but not limited to company deeds, permits, etc.);

      • personal data or the identity of the User's representative/person in charge;

      • the User's email address (including its representatives); and

      • data, information and/or documents related to the provision/sale of the services and/or products by Andalin using Andalin.com;

      
      

      "User" means you who access, take advantage and/or use Andalin.com; and

      
      

      "Privacy Policy" means this Privacy Policy including all of its content

      
      

2. COLLECTION OF USER'S INFORMATION

   1. The User explicitly agrees that this Privacy Policy binds and applies to the User whenever the User uses or accesses Andalin.com

   2. The User hereby represents that the User is a legal subject that is capable and able to agree upon this Privacy Policy. The User represents and warrants that the party representing the User has the capacity and authority to agree upon this Privacy Policy, and that the User does not require approval from any other third party in agreeing this Privacy Policy.

   3. If a User does not agree with either one, part, or all of the contents of this Privacy Policy, such User is not permitted to use Andalin.com and please immediately stop and exit Andalin.com

   4. The User expressly and explicitly agrees that Andalin (including its affiliates) may or will collect, store, and/or use the User's Data and Information deemed necessary for Andalin in connection with the use/utilization of Andalin.com by the User or in connection with the provision/sale of the services and/or products by Andalin using Andalin.com or in connection with the business continuity of Andalin (including its affiliates).

   5. The User expressly agrees that Andalin may forward the User's Data and Information deemed necessary by Andalin to any other parties who need to receive it or know it, in connection with the provision/sale of the services and/or products by Andalin using Andalin.com, with the purpose that such provision/sale of the services and/or products by Andalin could be carried out properly.

   6. Except as stipulated or permitted in this Privacy Policy, Andalin will not disclose the User's Data and Information to third parties.

   7. Andalin will take reasonable technical and organizational precautions to prevent loss, misuse or alteration of the User's Data and Information.

   8. The User expressly agrees that Andalin may store the User's Data and Information and/or other User's data in third party data centers including Amazon Web Services, Inc. data centers, Google LLC data centers, Microsoft Corporation data centers and data centers of other third parties deemed proper by Andalin, whereby the data center may be located in the Republic of Indonesia or in other countries outside the territory of the Republic of Indonesia

   9. The User hereby represents and warrants that any data, information and/or documents that the User provides (either directly or indirectly) to Andalin are accurate and correct. The User is responsible for any data, information and/or documents that the User provides (either directly or indirectly) to Andalin and the User holds Andalin harmless against any liability in connection with the accuracy and correctness of any data, information and/or documents that the User provides (either directly or indirectly) to Andalin.

   10. The User represents and warrants that the User has the right, authority and capacity to disclose the User's Data and Information and/or other User's data to Andalin.

   11. The User expressly agrees that Andalin may disclose the User's Data and Information:

       1. to the extent that Andalin is required to do so by law;

       2. to Indonesian customs and excise authorities or Indonesian tax authorities or any Indonesian state institutions or any Indonesian government agencies;

       3. in connection with ongoing legal processes or legal processes that will take place through court, arbitration, police, prosecutors, and all government agencies/Indonesian state institutions or other authorities;

       4. to enforce, implement or defend the legal rights of Andalin, any of Andalin's parent company and/or any Andalin's affiliate (including but not limited to providing information to other parties for the purpose of preventing fraud and reducing credit risk);

       5. to buyers (or potential buyers) of Andalin's (including any of Andalin's parent company or affiliate) business or businesses or assets and/or any, which Andalin (including any of Andalin's parent company or affiliate) will (or are considering to) sell;

       6. to potential investors who plan (or are considering) to invest (either directly or indirectly) in Andalin (including any of Andalin's parent company or affiliate); and/or

       7. to any person that Andalin believes may apply to a court or other competent authority for the disclosure of such User's Data and Information where in the reasonable opinion of Andalin such court or authority would reasonably require or permit the disclosure of the User's Data and Information.

   12. The User expressly agrees that Andalin will store documents (including electronic documents) containing User's Data and Information:

       1. to the extent that Andalin is required to do so by law;

       2. in connection with ongoing legal process or legal processes that will take place through court, arbitration, police, prosecutors, and all government agencies/Indonesian state institutions or other authorities; and

       3. to enforce, implement or defend the legal rights of Andalin, any of Andalin's parent company and/or any of Andalin's affiliate (including but not limited to providing information to other parties for the purpose of preventing fraud and reducing credit risk).

   13. Andalin may or is permitted to use cookies and/or other similar technologies in Andalin.com, to store information/data so as to enable the User to access or use the services available on Andalin.com optimally and to improve the performance of Andalin.com.

   14. Andalin will collect, store and process data on User visits to Andalin.com, including but not limited to location data, traffic data, or other communication data.

   15. When the User contacts Andalin.com or Andalin, Andalin may save records related to the correspondence and may save the contents of the communication between the User and Andalin.

3. MISCELLANEOUS

   1. This Privacy Policy shall also be subject to any provisions or laws that apply in Indonesia in connection with a privacy policy

   2. This Privacy Policy shall be governed and construed under the laws of the Republic of Indonesia.

   3. If one or more of the provisions in this Privacy Policy are invalid, void, contrary to law, or unenforceable in any way under any applicable law or judgment, then such provisions are deemed to be automatically removed from this Privacy Policy and deemed to have never existed, however the validity, legality and enforceability of the other provisions contained in this Privacy Policy will not be affected or impaired in any way whereby such other provisions will remain in full force and effect.

   4. This Privacy Policy is made in Indonesian language version and English language version, in the event of discrepancies or inconsistencies in interpretation between the Indonesian language version and the English language version, the Indonesian language version shall prevail, and the English language version shall be considered to have been amended to be consistent with the Indonesian language version of this Privacy Policy that it corresponds to.

   5. For the avoidance of doubt, the User shall include but not limited to Andalin's customers, Andalin's vendors or suppliers, vendors or suppliers for other User, and/or Andalin's partners.

   6. Any and all disputes relating to the interpretation or implementation of this Privacy Policy shall be resolved exclusively in the South Jakarta District Court, unless a User and Andalin agree otherwise in a separate agreement between such User and Andalin, where the provisions regarding choice of forum and/or place of dispute settlement in such separate agreement between the User and Andalin shall apply.
